Appearance and Information Release
By signing below, I grant permission to Simon Property Group, Inc and their parent, subsidiary and affiliated companies, and each of their respective officers, directors, shareholders, employees, agents, representatives and designees, as well as each of their respective successors, representatives and assigns (collectively, the “Parties”), to make recordings of my voice, picture and likeness in connection with the Event (“Appearance”), to use any portion of the Appearance and my name, city and state of residence, biographical material and any other information and/or materials provided by me (“Information”), and to produce, broadcast, exhibit and distribute, as well as authorize others to produce, broadcast, exhibit and distribute, the Appearance and Information for any purpose whatsoever, including but not limited to publicity, promotion and advertising (but not for any use constituting a direct endorsement by me of any product or service), worldwide, in perpetuity, in any media, including but not limited to broadcast, cable, pay television, video-on-demand, home video, DVD, audiotape, CD, the internet and any other media now existing or hereinafter created or conceived.
I understand that nothing herein shall obligate the Parties to use the Appearance and Information or any aspect thereof, and that the Parties may do so and may edit the Appearance and Information at their sole discretion. I also understand that I will not receive any financial compensation or remuneration for the Appearance and Information.
I hereby voluntarily accept any and all risks, known or unknown, associated with my Appearance and Information or any portion thereof. I and my heirs, executors, administrators and assigns hereby voluntarily release, discharge, waive and relinquish any and all claims, complaints, demands, losses, costs and expenses (including attorneys’ fees and disbursements), actions or causes of action (“Claims”) against the Parties, including but not limited to those Claims alleging defamation, invasion of privacy, right of publicity, misappropriation, property damage and personal injury, arising from or resulting in any manner from my Appearance and Information or any portion thereof. I agree to defend, indemnify and hold harmless the Parties in the event of any and all Claims, by whomever or wherever asserted, including but not limited to defamation, invasion of privacy, right of publicity, misappropriation, property damage and personal injury, resulting in any manner from my Appearance and Information or any portion thereof. I acknowledge that the use, production, broadcast, exhibition, discussion or presentation of the Appearance and Information by the Parties may be considered surprising, embarrassing, derogatory, defamatory, or otherwise offensive or injurious to me, and any injuries allegedly caused thereby are specifically included within the matters released herein.
I warrant and represent that, to the best of my knowledge, any statements made during the recordings of the Appearance or otherwise provided by me will be true and will not violate or infringe any third party’s rights. I warrant and represent that I have not accepted or agreed to accept, and will not accept or agree to accept, directly or indirectly, any money, service or other valuable consideration for the inclusion of any matter as part of the recordings of the Appearance, and that I will not, without the Parties prior consent, mention or identify in the recordings of the Appearance any product, service, trademark and brand name.
